Please find below a copy of the end-user licence agreement for The Report King. This is the licence you agree to when you purchase, download and install the program.
END-USER LICENSE AGREEMENT FOR "THE REPORT KING"
IMPORTANT-READ CAREFULLY: "The Report King" End-User License Agreement ("EULA") is a legal agreement between you (either an individual, organisation or a single entity) and The Happy Mongoose Company for the software product identified above, which includes computer software and associated media and printed materials, and may include "online" or electronic documentation ("SOFTWARE PRODUCT" or "SOFTWARE"). By purchasing, installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not purchase, install, copy, or use the SOFTWARE PRODUCT.
SOFTWARE PRODUCT LICENSE: The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
1. GRANT OF LICENSE. This EULA grants you the following non-exclusive rights:
* Software Product. You may install and use the enclosed SOFTWARE PRODUCT on your computers to write an unlimited number of school reports.
* Sample Reports: You may modify and use any of sample documents located within the SOFTWARE PRODUCT's "Built in reports" directory. No licence is given to modify any of the other files, including executables, help files, or report statement files.
* In the case of SINGLE-USER LICENCES, you may install and use the SOFTWARE PRODUCT on one COMPUTER only. If you wish to install the SOFTWARE on a second COMPUTER, you must first uninstall it completely from the first COMPUTER.
*In the case of SITE LICENCES, you may install and use the SOFTWARE PRODUCT on an unlimited number of COMPUTERs at the site specified when purchasing the SITE LICENCE. Employees of the purchasing organisation may install and use the SOFTWARE on one home computer, provided they uninstall it after they leave employment with the purchasing organisation, and make reasonable efforts to ensure that non-employees of the purchasing organisation do not use the SOFTWARE.
* You may not make or distribute copies of the SOFTWARE PRODUCT.
* You chose your LICENCE NAME when you ordered the SOFTWARE PRODUCT. Except in the event of your name changing with legal proof (e.g. by marriage), your LICENCE NAME may not normally be changed without purchasing a further licence for the SOFTWARE PRODUCT. Changing your Licence Name may incur a fee. The LICENCE NAME is displayed on the splash screen when the SOFTWARE PRODUCT starts and the Version screen from the "Advanced" menu.
2. COPYRIGHT. All rights, title, and copyrights in and to the SOFTWARE PRODUCT (including, but not limited to, any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the SOFTWARE PRODUCT) and any copies of the SOFTWARE PRODUCT are owned by The Happy Mongoose Company or its suppliers. You may not copy the printed materials, if any, accompanying the SOFTWARE PRODUCT.
3. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
* Limitations on Reverse-Engineering, Decompilation, and Disassembly. You may not reverse- engineer, decompile, or disassemble the SOFTWARE PRODUCT, or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
* Rental. You may not rent, loan, sublicense or lease the SOFTWARE PRODUCT.
* Software Transfer. Your rights under this EULA are non-transferrable (including, but not limited to, other individuals, entities or organizations.)
* Termination. Without prejudice to any other rights, The Happy Mongoose Company may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.
5. EXPORT RESTRICTIONS. You agree that you do not intend to or will, directly or indirectly, export or transmit the SOFTWARE PRODUCT or related documentation and technical data to any country to which such export or transmission is restricted by any applicable U.K. regulation or statute, without the prior written consent, if required, of any governmental entity as may have jurisdiction over such export or transmission.
NO WARRANTIES. To the maximum extent permitted by applicable law, The Happy Mongoose Company expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation are provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability or fitness for a particular purpose. No communication given by The Happy Mongoose Company or its representatives shall increase the scope of this warranty. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you.
LIMITATION OF LIABILITY. The entire liability of The Happy Mongoose Company, and your only remedy, shall be, at the discretion of The Happy Mongoose Company, the return of the price paid. This Limited Warranty is void if the failure of the SOFTWARE PRODUCT has resulted from accident, abuse or misapplication. To the maximum extent permitted by law, The Happy Mongoose Company shall not be liable for any damages whatsoever arising out of the use or inability to use the SOFTWARE PRODUCT, even if The Happy Mongoose Company has been notified about the possibility of damages.
UPGRADES. If this copy of the SOFTWARE PRODUCT was purchased as an upgrade from an earlier Happy Mongoose Company product, you agree by installing or copying this copy of the SOFTWARE PRODUCT to voluntarily terminate your earlier EULA. Furthermore you agree that you will not continue to use the earlier version of the SOFTWARE PRODUCT or transfer it to another person or entity.
